Temper appeals to the Supreme Court
On 16 June 2026, the Amsterdam Court of Appeal ruled that Temper should be classified as a temporary employment agency. This differs from the Amsterdam District Court’s July 2024 ruling that Temper is not a temporary employment agency, which dismissed all claims brought by FNV and CNV.
We’re surprised by the ruling and disagree with it. We’ll continue to defend people’s wish to choose how they work. We’ve appealed to the Dutch Supreme Court because we believe the ruling is wrong and have strong legal grounds to challenge it.
Until these proceedings conclude, the ruling is not final.
15,000 FreeFlexers stood up
At an earlier stage of the legal proceedings, 15,000 FreeFlexers made it clear that they did not want to be represented by FNV and CNV. They stated that they did not want to be part of proceedings that went against their way of working.
The way people want to earn extra income is changing. A new generation, in particular, increasingly values freedom and flexibility. Many people consciously choose a way of working that allows them to organise work around their lives, rather than the other way around. We will continue to stand up for our users and their freedom to work in a way that suits them.

A changing labour market needs clearer rules
