Which collective labour agreement is relevant for me?

For employed shifts, a collective labour agreement (CAO) is determined for each company and role.

For freelance shifts, a collective labour agreement (CAO) never applies, as you work as a freelancer rather than in an employment relationship.

What is a CAO?

A CAO is a set of agreements between employers and employees about working conditions. It outlines the rules and conditions that apply to your specific job, including salary, working hours, and other important terms.

It ensures everyone understands their rights and responsibilities at work. CAOs help create fair working conditions and protect both employees and employers.

What is the assignment agreement for freelance shifts?

For every freelance shift you are accepted for, an assignment agreement is created. The agreement is signed by both you and the client and contains all the terms and conditions for that shift. It protects both parties and ensures clear expectations.

Temper is not a party to this agreement; it is a direct agreement between you and the client.

How does signing work?

Because you have already accepted Temper's Terms of Use, the assignment agreement is automatically created and signed when you apply for a shift. Once the client accepts your application, the agreement becomes legally binding.

Where can I find the assignment agreement?

You can download the assignment agreement from the shift page of your accepted freelance shift.

What does this mean for you?

By applying for a shift, you agree to all the terms of that shift, including the working hours, hourly rate, tasks, cancellation policy, and required skills. If either party does not meet these terms, the agreement may be terminated and there may be consequences.

For example:

  • If you do not meet the shift requirements (for example, by wearing the wrong clothing), the client may mark you as a no-show.
  • On the other hand, if you arrive for your shift but the location is closed, you may be entitled to submit a claim.

Do I have a contract with Temper?

You can find two types of shifts on our platform: employed shifts and freelance shifts.

Working employed shifts with a phase A contract.

When working a employed shift, you’re employed by Temper for the duration of that shift. Understanding the terms of employment is essential. To begin with, you'll be working on a Phase A contract with an agency clause. Here are the key things to know:

Contract for every shift

When you apply for your first employed shift, you sign a framework agreement (’intentieovereenkomst’) with Temper. For every shift afterward, a labour agreement is automatically generated based on this framework agreement, using your existing signature.

Type of contract

As a temporary worker, you'll have a separate employment contract for each shift you accept. These are Phase A contracts with an agency clause. Although each contract is formally valid for four weeks, the agency clause means it automatically ends after each shift. As a result, you'll have multiple contracts throughout the year, one for each shift. You'll only be paid for the shifts you work.

You can work under a Phase A contract for up to 52 weeks in total. After that, Temper may decide to offer you a Phase B contract.

Compliance with regulations

The automatically generated labour agreements follow Dutch regulations and relevant CAOs (collective labour agreements), so you’re always treated fairly and paid at least the minimum wage.

Your previous work experience could affect your hourly rate. If you’ve worked with one of the companies before (either directly or through another agency), please contact support and let us know. It could affect your pay.

Surcharges

When working on irregular hours, such as weekends, nights, holidays, or overtime, surcharges may apply. If this is the case, you will earn more. You are also entitled to a travel allowance, and you will accrue pension benefits.

Wage & holidays

Your wage consists of the basic wage plus additional components such as holiday pay and holiday allowance, which are already included in your wage.

Cancellation

Both you and the hiring company can cancel a shift without consequences if it’s done more than 48 hours in advance. Within 48 hours, different rules apply. If the company cancels, they still have to pay you. If you cancel, it may be marked as a no-show, which can affect your profile.

Strike system

Unwarranted late cancellations, no-shows or significant complaints from companies may result in strikes. Getting 3 strikes will lead to being blocked for employed shifts.

Make sure you know the rules, so you’ll know exactly where you stand and won’t be faced with any surprises.

How do I sign the employment contract for employed shifts?

An employment contract is automatically generated for each employed shift. You do not need to sign it manually every time; when you sign up for a shift, your signature from the framework agreement is used. For freelance shifts, there is no employment contract since you worked these as a freelancer.

Framework agreement

You signed the framework agreement when you first signed up for an employed shift. This serves as the basis for all future employment contracts.

When is your employment contract created?

The employment contract is created within 48 hours before the start of your employed shift, depending on when you are accepted, and takes effect at the start of the shift.

Where can I find the labour agreement for my employed shift?

You can find the labour agreement for your employed shift in the app. Go to your Dashboards, find the relevant shift and find a link to your contract in the shift details.

When is the labour agreement created and available?

If you're selected more than 48 hours before the shift, your labour agreement will be generated and available 48 hours before the shift begins.

If you're accepted within 48 hours before the shift starts, your labour agreement will be ready right after acceptance.

Working employed shifts with a phase B contract.

When you move to a phase B contract, you still work per shift just like before. The main difference is the type of employment contract underneath: in phase B, your contract runs for a longer period and includes a minimum number of hours. Below you’ll find all key questions and answers in one place.

What is a phase B contract?

A phase B contract is a fixed-term employment contract that runs for a longer period while you continue working per shift. There is no agency clause (uitzendbeding) that ends the contract early. A phase B contract simply adds more stability.

How long does my contract last?

Your contract no longer covers just one shift at a time. It runs for a fixed period. The exact duration is written in your contract. Unlike in phase A, the contract does not automatically end after each shift. It continues for the full agreed period and ends on the end date in your contract.

How do I become eligible for a phase B contract?

You can be invited when there is a good likelihood of ongoing work, when your performance is reliable, and when you have completed 52 worked weeks in phase A. If there is a 6-month break without any contracts, the counter resets.

How many hours will I work each week?

Your contract includes a minimum number of hours you are expected to work. The actual hours you work can vary from week to week, and it is completely fine to work more than the minimum.

For how many hours will I be paid?

You’re paid for the hours you work. If you don’t meet the minimum because you didn’t pick up available shifts, those hours aren’t paid.

Do I still need to apply for shifts?

Yes. You keep applying as usual for shifts in the app. You are expected to apply for at least the minimum hours stated in your contract. The minimum hours only apply if you actually apply for available and suitable shifts.

What happens when I get sick?

You are covered under our sickness policy. While you’re sick, you cannot pick up new shifts until you report that you’ve recovered. Please report sick to Support as soon as possible so we can guide you through the steps.

Can I cancel a shift?

Yes, you can still cancel a shift. Please make sure to do so as early as possible, so the client still has time to find someone else. Keep in mind that you remain responsible for picking up enough shifts over a longer period to meet your minimum hours.

Can I take holidays?

Yes. You can choose not to work for a certain period. If you take time off, just make sure you still pick enough shifts in the longer period to reach your minimum hours. You continue to accrue holiday hours and these are paid out directly.

Can the contract be terminated early?

The contract normally can’t be ended early. If you stop picking up shifts, it simply continues, but you won’t be paid for hours you don’t work. Temper can only end the contract early in exceptional situations.

What happens at the end of my contract?

When the contract ends, both you and Temper can decide whether you want to continue with a new contract.

What are the employment terms and conditions in phase B?

They are generally the same as in phase A. This includes your pay, holiday pay, travel allowance and pension build-up, all following Dutch employment rules and the applicable CAO.

What are my responsibilities?

Your responsibilities remain similar to what you are used to. You apply for your shifts, show up reliably, keep good communication with the companies, and inform support quickly if you become sick or if something changes. You are also responsible for meeting the minimum hours agreed in your contract over a longer period.

What is the framework agreement for employed shifts?

A framework agreement is a base document that outlines the conditions under which you will work future paid shifts. Once signed, it is used to automatically generate an employment contract for each employed shift you work. For freelance shifts, there is no employment contract, so the framework agreement does not apply.

When do I sign the framework agreement?

You sign the framework agreement when you first sign up for a paid shift. This is done online via Stiply. If you later change your payroll tax credit settings, you will be asked to sign the agreement again.

What happens to the framework agreement?

After signing, the framework agreement is stored and used to automatically create an employment contract each time you book a shift. It contains your basic details and agreed terms, but does not create any ongoing obligations.

In short: a one-time setup that enables quick and easy processing of future shifts.

What type of contract do I have for my employed shift?

When working an employed shift, you are employed by Temper as a temporary worker (‘uitzendkracht’ in Dutch). To start you’ll get a so called ‘phase A contract’ with ‘uitzendbeding’ (agency clause).

Phase A with agency clause

For every employed shift you are accepted for, you receive a separate employment agreement. The contract is formally valid for 4 weeks, but due to the agency clause, it ends automatically after each shift. This means you’ll have multiple contracts per year, one for each employed shift. You are only paid for the hours you work; if there’s no work, you are not paid.

Phase B

You can work for a maximum of 52 weeks under Phase A. Each week in which you work one or more employed shifts counts as one week. After that, Temper may offer you a Phase B contract.

Your employment terms follow the collective labour agreement (CAO) for your role and the arrangements set out in the intent agreement you signed when you joined, including minimum wage and other legal requirements.

Is my employed shift contract in line with labour regulations?

In the Netherlands, employment conditions are mainly set by labour law. These rules cover things like maximum working hours and required breaks, even if you have multiple contracts in one week. Your employed shift contract fully complies with these laws.

Working Hours Act

  • Maximum weekly hours: There’s a limit to how many hours you can work per week. If you work a lot of hours for several weeks in a row, your allowed weekly average goes down.
  • Breaks: You’re entitled to minimum break times, depending on how long your shift is.
  • Rest time: You need at least 11 hours of rest between two working days. If you work night shifts, that rest period is longer.

To stay compliant with the Working Hours Act, we may sometimes cancel employed shifts or withdraw your application for a shift.

CAO (Collective Labor Agreement)

Alongside the general rules, CAOs (collective labour agreements) may include extra rules for your shift. We always make sure your shift follows these rules. Depending on the CAO you might, for example, be entitled to extra pay for things like overtime, night work, public holidays, or weekend work.

What happens to my contract when I cancel an employed shift?

Your labour contract only starts when your employed shift begins. If you cancel beforehand, the contract is automatically cancelled. But there may be consequences, so do keep the cancellation rules in mind:

More than 48 hours before your shift

There are no consequences.

Within 48 hours

This may count as a no-show and lower your attendance rate. While cancelling via the platform, you can explain to the company why you’re missing the shift; the company decides whether to report a no-show or not. You may also receive a strike for late cancellations.

For employed shifts, you can’t arrange a substitute, this is only possible for freelance shifts.

What if I didn’t cancel the shift through the platform?

If you don’t show up for your employed shift, the company can mark you as a no-show. In that case, your contract is automatically canceled. This means the employment agreement for that shift is void, and you have no further obligations for that shift.
